What Is No-Fault Automobile Insurance?

In theory no fault insurance is supposed to limit the number of lawsuits filed for automobile accidents. There are three different categories of no fault insurance laws. You have pure no fault laws, modified no-fault laws, and add on no-fault laws. The state in which you reside will dictate the specific no fault insurance laws. Let’s examine no-fault insurance in Kentucky.

No Fault Insurance in Kentucky, How Does It Work?

No-fault insurance laws in Kentucky require the first $10,000 in medical expenses, lost wages, or other expenses to be paid by your insurance company and not the responsible party who caused the accident. Please note that Kentucky no fault insurance does not cover property damage. So in other words if someone slams into your car, and you are not injured but your vehicle is damaged, the other responsible parties insurance will pay for the damage to your vehicle!

If you are injured with relatively minor injuries, your insurance will pay up to $10,000 subject to any deductibles that you may have chosen. No fault insurance in Kentucky is referred to as Personal Injury Protection.

No-Fault Insurance in Kentucky Limits Your Ability to Sue for Injuries.

Please note the specific no-fault Kentucky law in regards to lawsuits:

If you have No-Fault coverage, your right to sue the at-fault party is limited unless your injury involves a broken bone, permanent disfigurement, medical expenses over $1,000, permanent injury, or death. With these injuries that exceed the No-Fault thresholds, you retain your right to sue for pain and suffering and expenses not included by No-Fault coverage

If you suffer an automobile accident in Kentucky and your medical expenses exceed $1000 you can pretty much feel free to sue the pants off responsible party! (A trip to the emergency room could likely be more than $1000.) There is one dark side to no-fault insurance laws.

It’s Very Difficult to Find Cheap Car Insurance in Kentucky

Insurance companies typically pay out more money in claims under no-fault insurance laws compared to non-no-fault insurance laws. What that means to you when you buy Kentucky car insurance is a higher insurance bill compared to your neighbors to the north. (Drivers in Ohio may pay up to 40% less than Kentucky drivers.)
